Bespoke Travel Collections – Terms & Conditions

Introduction
These Terms & Conditions govern bookings made with Bespoke Travel Collections (“we”, “us”, “our”). By booking one of our tours, you (“you”, “your”) agree to be bound by these terms. Bespoke Travel Collections is a tour operator, designing and delivering tours and experiences. We do not provide flights or act as a travel agency for third-party products. Travel to or from tour departure points is your responsibility.
These Terms & Conditions apply to all tours, retreats, hosted journeys, yacht experiences, and travel experiences operated by Bespoke Travel Collections. Specific itineraries, inclusions, exclusions, and conditions applicable to each tour will be outlined in the booking form and itinerary provided for that specific tour. If there is any inconsistency between these Terms & Conditions and the specific tour booking form, the booking form will prevail to the extent of the inconsistency. These terms apply to all travellers worldwide, including residents of Europe, North America, Asia, Africa, and other regions.
Booking and Payment
Tours are confirmed only once payment is received in accordance with this schedule:
- Spot Reservation: $200 to secure your place (refundable if the tour does not meet minimum numbers).
- Deposit: 20% of the total tour cost, due within 7 days of tour release.
- Final Payment: Remaining balance due 120 days before departure.
- Late Bookings: If booking within 120 days of departure, full payment is required at the time of booking.
Payment Methods
Wise Business: Payments can be made in your own currency. Wise card payments accepted; fees deducted by Wise: domestic consumer cards 1%, international consumer or business cards 2.9%. Bank Transfer: Available for Australian residents in AUD. Clients are responsible for all transaction fees. Tours will not be confirmed until payments are cleared. Prices are subject to change prior to full payment due to currency fluctuations, supplier cost increases, fuel surcharges, taxes, or government charges outside our control. International travellers are responsible for any foreign transaction fees, currency conversions, or additional taxes imposed by their country of residence. Failure to make payment by the due date may result in cancellation of the booking and forfeiture of amounts already paid.
Cancellation and Refunds
Non-Refundable Payments: Deposits and final payments are non-refundable if cancelled by you, except where required under Australian Consumer Law.
Cancellation Fees
- 60+ days before departure: Loss of deposit.
- 59–31 days before departure: 50% of total tour cost.
- 30 days or fewer before departure: 100% of total tour cost.
Cancellations must be made in writing. Cancellation fees do not reduce supplier cancellation fees, which may also apply. No refund will be provided for unused services, missed activities, or early departure from the tour. Bespoke Travel Collections strongly recommends that all travellers obtain comprehensive travel insurance that covers cancellation and curtailment, including international travellers who may have different insurance requirements.
Role of Bespoke Travel Collections
Bespoke Travel Collections operates primarily as a tour operator and organiser of curated travel experiences. For hosted tours, retreats, and curated travel experiences, Bespoke Travel Collections designs the itinerary and contracts directly with hotels, activity providers, transport operators, and other suppliers in order to deliver the travel experience. These services are provided as part of the overall tour package organised by Bespoke Travel Collections.
While Bespoke Travel Collections contracts with suppliers to deliver services within the itinerary, those suppliers remain independent contractors responsible for the operation and safety of their services. In some circumstances, Bespoke Travel Collections may provide Booking and Advisory Services that allow travellers to acquire travel products from travel providers (“Providers”). When arranging these third-party travel products, we act as an agent for the Provider, unless otherwise specified. Travel providers supply their products subject to their own conditions which may include amendment fees, cancellation fees, or non-refundable payments. By acquiring Booking and Advisory Services from us, you agree that you have read and understood: • these Terms & Conditions • the relevant Provider’s Terms and Conditions

Itinerary Changes
Travel itineraries may change due to weather, safety considerations, operational requirements, supplier availability, or other circumstances beyond our control. Bespoke Travel Collections reserves the right to: • modify itineraries • substitute accommodation or activities • alter routes or schedules • replace suppliers with comparable alternatives Where possible, changes will be communicated in advance. Such changes do not entitle the traveller to a refund.
Minimum Numbers
Some tours require a minimum number of participants in order to operate. If minimum numbers are not reached, Bespoke Travel Collections reserves the right to cancel the tour. In this event, any payments made will be refunded in full. No additional compensation will be payable.
Traveller Responsibilities
Travellers are responsible for ensuring they meet all travel requirements, including: • valid passports • visas • vaccinations or health requirements • travel documentation • compliance with entry regulations Travellers must ensure they are physically and medically fit to participate in the tour. Some tours may involve active or adventure-based activities including but not limited to: • hiking • surfing • swimming • water sports • boating • outdoor physical activities Participation in such activities is voluntary and undertaken at the traveller’s own risk.
Travellers must follow all safety instructions provided by guides, instructors, crew members, and local operators. Bespoke Travel Collections reserves the right to remove a participant from a tour if their behaviour endangers themselves or others or disrupts the experience for the group. No refund will be provided in such circumstances.
Health and Medical Conditions
Travellers must disclose any relevant medical conditions, dietary requirements, or accessibility needs prior to booking. Bespoke Travel Collections cannot guarantee that all dietary or medical requirements can be accommodated in all destinations. Travellers are responsible for carrying necessary medications and ensuring they are legally permitted in the destination country. International travellers should check local healthcare availability and travel insurance coverage for overseas destinations.
Adventure Activities and Risk Acknowledgement
Some tours include active, adventure, or water-based experiences which carry inherent risks. By participating in a Bespoke Travel Collections tour you acknowledge that: • travel activities may involve risks including injury, illness, or property damage • activities may take place in remote locations or on open water • safety standards may vary by country or operator You voluntarily accept these risks and agree that participation is undertaken at your own discretion.
Yacht Charters and Maritime Activities
Certain tours may include yacht charters or boating experiences. All vessels are operated by licensed captains or charter operators in accordance with local maritime regulations. Bespoke Travel Collections does not operate vessels directly unless explicitly stated and is not responsible for vessel operation or navigation. Weather and sea conditions may require changes to itineraries, routes, ports, or activities for safety reasons.
Travel Insurance
Comprehensive travel insurance is strongly recommended for all travellers. Travel insurance should include coverage for: • trip cancellation • medical emergencies • evacuation (including international medical evacuation) • personal liability • lost or delayed baggage • adventure activities where applicable Bespoke Travel Collections is not responsible for any losses that could have been covered by travel insurance. International travellers are responsible for obtaining insurance valid in the jurisdiction they are travelling from and to, including coverage for medical evacuation and repatriation.
Liability
To the fullest extent permitted by law, Bespoke Travel Collections will not be liable for: • injury • illness • loss or damage to property • delays • travel disruption • acts or omissions of third-party suppliers • weather events • natural disasters • government actions • strikes or industrial action • force majeure events Nothing in these Terms excludes or limits rights that cannot be excluded under Australian Consumer Law.
Force Majeure
Bespoke Travel Collections is not liable for failure or delay in performing obligations due to events beyond reasonable control including but not limited to: • natural disasters • extreme weather • pandemics or epidemics • government restrictions or travel bans • war, threat of war, armed conflict • terrorism or threat of terrorism • civil unrest or political instability • strikes or industrial action • transport disruptions • border closures • acts of God In such circumstances, itineraries may be changed, postponed, or cancelled for safety or operational reasons. Where a tour is cancelled, postponed, or modified due to a Force Majeure event, refunds will not be provided. Bespoke Travel Collections may, at its discretion, offer a credit, alternative tour date, or revised itinerary. Travellers are responsible for claiming any losses through their travel insurance provider.
Traveller Behaviour & Conduct
Travellers must behave in a manner that does not disrupt the group, staff, or suppliers. Bespoke Travel Collections reserves the right to remove any participant from a tour or activity for: • aggressive, abusive, or illegal behaviour • harassment of staff, other participants, or locals • repeated non-compliance with safety instructions • actions that endanger themselves or others No refund will be provided if a participant is removed due to behaviour or misconduct.
Alcohol, Drugs, and Personal Responsibility
Travellers are responsible for their own consumption of alcohol and any substances. Bespoke Travel Collections does not accept responsibility for accidents, incidents, or injuries arising from alcohol or drug consumption. Suppliers may refuse service to intoxicated participants; failure to comply with their rules may result in removal from the tour or activity with no refund.
Damage to Property
You are held responsible for any damage caused to accommodation, vessels, or equipment provided as part of the tour. Any costs associated with repairs or replacements will be your responsibility and must be settled immediately with the relevant service provider.
International Travellers
All participants travelling from overseas must ensure they hold a valid passport and comply with all health, vaccination, and entry requirements of the destination country. Bespoke Travel Collections is not responsible for any issues arising from failure to meet these travel requirements.
Visas and Immigration
It is the traveller's sole responsibility to secure all necessary visas, transit permits, and authorisations required for their journey. We recommend verifying immigration requirements well in advance. Denied entry based on incorrect documentation is not a ground for a refund.
Medical Evacuation & Emergency Assistance
Bespoke Travel Collections is not a medical provider. In the event of a medical emergency during a tour, we will facilitate contact with local emergency services, but all costs associated with medical care and emergency evacuation (including air or sea transport) are the sole responsibility of the traveller. It is mandatory for all participants to maintain travel insurance that specifically includes international medical evacuation.
Privacy and Data Protection
We collect personal information solely to process your booking and deliver our tour services. This information may be shared with necessary third-party suppliers (such as hotels and transport providers). We handle all data in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By booking, you consent to the collection and use of your personal information for these purposes.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes or claims arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
Acceptance
By paying a deposit, reservation fee, or participating in a tour, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions in their entirety. These terms constitute the entire agreement between you and Bespoke Travel Collections regarding your travel experience.
